On the windy afternoon of October 30, 1998, thirty-one year old Jeffrey Gath was riding his bicycle home from work along Chelmsford Street in Lowell when a large, chain-link gate owned by M/A-COM, Inc., unexpectedly swung open into the street. Although there was conflicting eyewitness testimony as to whether the gate actually struck Gath or his bicycle, there is no dispute that he fell and struck the pavement.
