On March 5, 1999, Matthew Berube got into bed with his then wife, the defendant Christine Berube,1 and their two month old daughter with a sawed-off .22 caliber rifle. Shortly, thereafter the weapon discharged causing injuries to the defendant. Subsequently, the defendant brought an action against Matthew Berube seeking to recover damages.
