Luther Sutton appeals the judgment of the trial court dissolving his marriage with Carmen Murphy Sutton. Mr. Sutton claimed in his answer to Ms. Sutton's petition for dissolution and throughout the proceedings that the parties were not married. Mr. Sutton claimed that he was married to another woman, Bernice Sutton, by common law when the marriage between Carmen and himself was solemnized in Roanoke, Virginia, on August 6, 1998, and, thus...
