In April 1999, defendant was arraigned on a two-count indictment charging him with crimes related to a sexual assault. A superceding indictment charged defendant with two counts each of rape and sodomy, by force or while the victim was incapable of consent by virtue of being physically helpless. Prior to the September 2000 trial, defendant twice moved to dismiss the indictment on speedy trial grounds, each time unsuccessfully. The jury found defendant guilty...
