Defendant was indicted for assault in the first and second degrees and, following a jury trial, was convicted of two counts of assault in the second degree. The convictions stemmed from a physical altercation with Marilyn Oliver at her apartment at 592 Central Avenue in the City of Albany around midnight on March 4, 1999.
