A.B. Bernard, Jr. and BGI Enterprises, Inc.1 sued Jefferson County under the real estate fraud statute. See Tex. Bus. & Com.Code Ann. § 27.01 (Vernon 2002). The County filed a plea to the jurisdiction based on governmental immunity from suit. The trial court denied the County's plea, and the County filed this interlocutory appeal.
