[¶ 1] This is an appeal from a judgment finding appellant Mark Quixote Van Haele guilty of aggravated assault and battery upon the district court's acceptance of an unconditional plea of nolo contendere under a plea agreement. In addition, Van Haele seeks relief from the district court's refusal to allow him to withdraw his plea at the sentencing hearing.
