Opinion by Justice ROSS.

David Drichas was convicted by a jury for evading detention with a motor vehicle. See Tex. Pen.Code Ann. § 38.04(a), (b)(1) (Vernon 2003). The jury also found that, during the commission of the offense, Drichas used his truck as a deadly weapon. See Tex. Pen.Code Ann. § 12.35(c)(1) (Vernon 2003).
