The order of the Appellate Division should be affirmed.

Defendant appeals his conviction following a bench trial for sexual abuse of his stepdaughter. With respect to the issue of alleged judicial bias that divided the Appellate Division, we agree with the majority that defendant's claim was unpreserved for appellate review (1 A.D.3d 533, 534 [2003]).
