The complaint in this case charges defendant Yevgeny Grinberg with operating a motor vehicle while under the influence of alcohol (Vehicle and Traffic Law § 1192 [1], [3]). At the conclusion of the People's case and after the People rested in this bench trial, defendant moved, pursuant to CPL 290.10, for a trial order of dismissal of all the charges in this matter...
