This case arises from a negligence suit filed by appellee Pan American Express, Inc. (Pan Am) against appellant Jose Cumpian (Cumpian). Pan Am's suit against Cumpian stemmed from a single vehicle accident which occurred while Cumpian was an employee of Pan Am.
