Ordered that the order is modified, on the law, by deleting the provision thereof granting that branch of the plaintiff's cross motion which was to strike the defendant's answer based upon its spoliation of evidence to the extent of precluding the defendant "from presenting evidence that it lacked notice of the condition that caused plaintiff's accident," and substituting therefor a provision granting that branch of the motion only to the extent of precluding the defendant...
