Plaintiff commenced this personal injury action against defendant Franklyn Akey (hereinafter defendant) and defendant Nicole Joyal alleging negligence in the operation of each of their respective motor vehicles. Prior to trial, plaintiff settled her claim against Joyal and discontinued the action against her.
