The State twice indicted appellant Enrique Grimaldo for murder. A jury convicted him of the lesser offense of manslaughter, a third-degree felony at the time of commission of the crime.1 The jury assessed his punishment at eight years confinement in the Institutional Division of the Texas Department of Criminal Justice and assessed a $5,000 fine.
