On April 27, 1998, the defendant was convicted, upon a jury verdict, of manslaughter in the first degree. By decision and order dated November 6, 2000, this Court modified the judgment by vacating the sentence imposed, finding that the Supreme Court had improperly considered crimes of which the defendant was acquitted as a basis for sentencing.
