On July 24, 2003, this court affirmed a September 2002 decision by the Board of Immigration Appeals (BIA) denying asylum and withholding of deportation to Said Guirguis Khalil. Khalil v. Ashcroft, 337 F.3d 50, 54, 56 (1st Cir.2003). The BIA had granted Khalil a thirty-day period of voluntary departure, which expired while his petition for review was pending before this court.
