JAN P. PATTERSON, Justice.

The State appeals from the trial court's order granting appellee Brian David Losoya's motion to suppress evidence. See Tex.Code Crim. Proc. Ann. art. 44.01(a)(5) (West Supp.2004). Because we find no error, we affirm the order.
