OPINION

BILLINGS, Presiding Judge.

¶ 1 James Webb appeals the trial court's order granting the University of Utah's (University) motion to dismiss pursuant to rule 12(b)(6) of the Utah Rules of Civil Procedure. We reverse and remand.
