Kerry Eugene Moore's conviction for retaliation arises from an altercation between Moore and a school superintendent. The State charged Moore with assault on a public servant and retaliation. A jury acquitted Moore on the assault charge but convicted him of retaliation. Moore contends that the evidence is legally and factually insufficient to support his conviction and that the court erred by: (1) failing to quash the indictment...
