Ordered that the resettled order is reversed insofar as appealed from, on the law and as a matter of discretion, without costs or disbursements, and the matter is remitted to the Family Court, Queens County, for an evidentiary hearing to be conducted with all deliberate speed and a new determination based thereon; and it is further,

Ordered that pending a new determination custody of the child shall remain with the father...
