This is a case of first impression for this circuit on several issues under the Lanham Act, 15 U.S.C. § 1051 et seq.

The plaintiff, formerly known as the State Compensation Insurance Fund, was chartered in 1990 by the Rhode Island legislature as the workers' compensation insurer of last resort in the state.
