Opinion by Justice ROSS.

The trial court dismissed Anthony Allen's malpractice lawsuit against attorney Steven L. Rushing for want of prosecution. On appeal Allen contends (1) that the trial court's dismissal did not serve the ends of justice, (2) that the trial court failed to provide him with a fair hearing, (3) that his suit against Rushing has merit, and (4) that the trial court failed to follow proper procedure resulting in an improper dismissal...
