Mahendra Bhatia, a 56-year old male of Indian descent, was terminated by AT & T as part of a downsizing plan implemented in September 2001. Plaintiff brought this suit against AT & T, alleging various forms of discrimination and retaliation. AT & T moved for summary judgment.
