Aggrieved by the decision to commit him to the appellee hospital, the appellant, Harvey Cohen, commenced this appeal in accordance with G.L. chapter 123, §9(a). The appellant tests the sufficiency of the evidence as a matter of law to support the trial court's finding that the failure to retain him at the appellee hospital would create a likelihood of serious harm, and that there existed no setting less restrictive.
