Justice GREIMAN delivered the opinion of the court:

The defendant, Ronald Schickel, Jr., was indicted for first and second degree murder, felony murder based upon mob action, and aggravated battery. Prior to trial, the State dismissed all counts against the defendant with the exception of the felony murder charge. After a bench trial, the defendant was found not guilty of felony murder and the predicate felony of mob action, but was found guilty of involuntary manslaughter...
