This case involves whether seed samples are public records under the Arkansas Freedom of Information Act (hereinafter "FOIA"). The Pulaski County Circuit Court, Honorable Jay Moody presiding, found that the actual physical seeds that were the subject of the FOIA request did not fall under the terms and definition of "public records," as defined by Ark.Code Ann. § 25-19-103(5)(A) (Supp.2003). We affirm.
