Appellant Gary Gray Roy was convicted by a jury of unauthorized use of a motor vehicle ("UUMV") and retaliation. See TEX. PEN.CODE ANN. § 31.07(a) (Vernon 2003), 36.06 (Vernon Supp.2004). The jury sentenced appellant to one year's confinement for the offense of UUMV and five years' confinement for the retaliation offense.
