Donald A. Fenner, petitioner, was tried by a jury in the Circuit Court for Frederick County and was convicted of distribution of cocaine and conspiracy to distribute cocaine. On May 9, 2002, the trial judge sentenced petitioner to twenty years of incarceration for the distribution of cocaine conviction and a concurrent sentence of twenty years for the conspiracy to distribute cocaine conviction.
