¶ 1. On February 20, 1998, Joseph Davis, Jr. went to the J.C. Penney store in Biloxi attempting to return some merchandise purchased at another J.C. Penney store. Davis claims that employees of J.C. Penney were hostile toward him and called the Biloxi Police Department resulting in his arrest for trespassing and resisting arrest. On June 8, 1998, Davis was convicted of resisting arrest and trespassing by the Biloxi Municipal Court....
