This cause comes before the Court on Defendant Continental Airlines, Inc.'s ("CAL") Motion to Dismiss (Doc. No. 18). Plaintiff filed a response in opposition to this motion (Doc. No. 29).

I. Standard of Review

In deciding a motion to dismiss, the district court is required to view the complaint in the light most favorable to the plaintiff. See Murphy v. Federal Deposit Ins. Corp.,
