This declaratory judgment action is before the Court for consideration of the Plaintiffs "Motion for Summary Judgment" (Doc. 36) and the Defendant's "Cross-Motion for Summary Judgment" (Doc. 39).1 These motions are ripe for review and the Court concludes that the Plaintiffs motion is due to be granted.
