In 1995, federal officials detained Martin Barajas-Chavez at a traffic checkpoint near Gallup, New Mexico while he was transporting ten illegal aliens in a pickup truck bound for Colorado. He was subsequently indicted on two counts of transporting illegal aliens from Arizona to New Mexico in violation of federal immigration law. A jury convicted Barajas-Chavez on both counts.
