Dwight Carlisle, in his official capacity as Commissioner of Revenue of the State of Alabama, and the Alabama Department of Revenue (hereinafter referred to collectively as "the Department"), petition this court for a writ of mandamus directing the trial court to dismiss an appeal of a final tax assessment filed by Jemison, Mendelsohn & James, P.C. (hereinafter referred to as "the taxpayer"). We grant the petition and issue the writ.
