This cause is before the court upon the motion of the defendant, Dover Corporation/Rotary Lift Division Dover Industries Company ("Rotary Lift") for summary judgment on its counterclaim. In its counterclaim Rotary Lift seeks to recover attorney's fees pursuant to the contract that formed the basis of the complaint.
