In April 1999, James A. Mellowitz filed a Complaint for Declaratory Relief against Ronald W. Frazier, seeking a determination from the trial court that Frazier had breached the terms of the parties' litigation referral agreement and that Mellowitz owed Frazier nothing under the terms of that agreement.
