In this medical malpractice litigation concerning the Vitek jaw implant, the State of Louisiana through the Louisiana State Board of Dentistry and John Kent, D.D.S. (relators) seek supervisory review of the order referring their exception of prescription to the merits of the case.

On December 5, 1991, plaintiff sued Dr. John Kent in medical malpractice averring:
