The defendant, Ronald W. Adams, was indicted for two counts of first degree murder (counts I and II) under La. R.S. 14:30, and pled not guilty on each count. Following a jury trial, he was found guilty as charged on both counts by unanimous verdict. The jury was unable to reach a unanimous verdict on either of the counts during the penalty phase. Defendant moved for a new trial, a post-verdict judgment of acquittal, and arrest of judgment,
