Pursuant to MCR 7.215(J), this Court convened a special panel to resolve the conflict between this Court's partially vacated opinion (Section I only) in People v. Seiders, 259 Mich.App. 538, 675 N.W.2d 611 (2003), and this Court's prior opinion in People v. Johnson, 205 Mich.App. 144, 517 N.W.2d 273 (1994). We conclude that
