Arlie Ashby (hereinafter referred to as "Mr. Ashby") appeals an adverse decision by the Circuit Court of Marion County dismissing his appeal of an order of the Police Civil Service Commission that affirmed his discharge as a patrolman with the City of Fairmont Police Department (hereinafter referred to as the "Police Department").
