ORDER

THRASH, District Judge.

This is a pro se civil rights action in which the Plaintiff seeks to set aside his criminal conviction. It is before the Court on the Plaintiffs Motion for Default Judgment [Doc. 4] and the Defendant's Motion to Dismiss Complaint [Doc. 7]. For the reasons set forth below, the Court DNIES the Plaintiffs Motion for Default Judgment and GRANTS the Defendant's Motion to Dismiss Complaint.
