This case is before this Court upon the July 31, 2002, order of the Circuit Court of McDowell County, West Virginia, finding the appellant, Jason H., guilty of malicious assault and adjudicating him to be a juvenile delinquent within the meaning of W.Va.Code, 49-1-4 [1998].1 As a result, the Circuit Court, by order entered on April 7, 2003, directed that the appellant be confined at the Industrial Home for Youth in Salem...
