In 2001, the City of Independence (City) determined that a home owned by Mr. Robert L. Woodson was a dangerous building. Mr. Woodson appealed this finding to the circuit court. The City sought summary judgment on the grounds of collateral estoppel, asserting that the house had already been found to be a dangerous building in 1996 and, therefore, it was unnecessary to relitigate this issue.
