This is an appeal of a final order granting the State's Motion for Summary Judgment and imposing discovery sanctions and costs against Roco Tobacco and its attorney. We affirm the lower court on the grant of summary judgment and on the imposition of discovery sanctions under Fla. R. Civ. P. 1.380, but reverse as to the costs awarded sua sponte.
