The primary issue is whether we will apply Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579, 113 S.Ct. 2786, 125 L.Ed.2d 469 (1993), to workers' compensation cases. A Workers' Compensation Court review panel held that Daubert did not apply to the proceedings. Because the Nebraska rules of evidence do not apply in workers' compensation cases, we hold that Daubert principles do not apply. We...
