Opinion of the Court by FOLEY, J.

Defendant-Appellant Raquel Bermisa (Bermisa) appeals from the Judgment filed January 10, 2001 in the Circuit Court of the First Circuit (circuit court).1 Bermisa was charged with and convicted of Manslaughter, in violation of Hawaii Revised Statutes (HRS) §§ 707-702(1)(a) (1993 & Supp.2002)2 and 702-203(2)3 (1993).
