The defendant, Calvin R. Pitre, was charged by grand jury indictment with first degree murder. He pled not guilty. The district attorney amended the indictment to allege second degree murder in violation of LSA-R.S. 14:30.1. Defendant was arraigned again and pled not guilty to that charge. After a trial by jury, defendant was found guilty as charged. He was sentenced to life imprisonment at hard labor, without benefit of parole, probation, or suspension...
