Kafayat Abimbola-Amoo pleaded guilty to possession of heroin with intent to distribute and was sentenced to 57 months' imprisonment. At sentencing she argued for a downward departure premised on her belief that after completing her sentence she will be deported to Nigeria and imprisoned again for the same conduct. The district judge refused to depart on this
