MEMORANDUM OPINION AND ORDER

McPHERSON, United States Magistrate Judge.

This case is pending on a complaint filed by the plaintiff William Maddox ["Maddox"] against Defendant USA Healthcare-Adams, LLC ["Adams"] on 6 October 2004 (Doc. # 1). Maddox alleged that the defendant terminated him from his employment because of age discrimination, in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq.,1
