Moore, Jr., filed a complaint against CNA Insurance Company, d/b/a Continental Casualty Company ("CNA"), the appellee, on September 26, 2000. In that complaint, Governor Moore asserted a breach of contract claim arising from CNA's refusal to provide a defense for him in State of West Virginia v.
