Nathaniel and Stephanie Cook received insurance payments for a fire loss that they believed was caused by Lavine's Heating and Sheetrock Co. These payments were their policy limits and did not fully cover the damages. Their insurer, USAA, retained a $212,000 subrogation lien against any recovery obtained by the Cooks.
